アスベスト判決 国の怠慢が被害を拡大させた

こうして判決が出てもただ国の責任というだけで当時の担当者は処罰されない。
そして判決で勝訴した人々には国民の血税から支払いがなされる。
血税の不足分は国債をどんどん発行してそれを補う。
裁判所は本当にそう思うのなら当時の担当者も処罰してほしい。
ひとまず被害者の苦しみを救った今回の裁定は評価できる。

阪神淡路大震災のおり、スラチャイはたまたま日本勤務、
すぐに大阪の阪神電車の倒壊した高架橋の復旧工事に派遣された。
離婚していて家族のいなくなったスラチャイは危険地区への派遣は適任だと考えられていた。
ここは倒壊したビルからアスベストが飛び交い、マスクを支給されてそれをつけて作業をした。
いま考えるとあのとき支給されたマスクは安物、アスベストの進入を簡単に許してしまう。
数ヶ月で復旧工事は終わったので大丈夫だと思うが…

Govt needs to get serious about asbestos, victims
アスベスト判決 国の怠慢が被害を拡大させた(5月20日付・読売社説)

Despite being aware of the health risks posed, the government neglected to take the necessary measures to protect the nation's citizens from being exposed to deadly asbestos, leading to an increased number of people suffering from health problems, a court has ruled.
 アスベスト(石綿)の危険性を早くから知りながら、国は必要な対策を怠り、健康被害を拡大させた――。

Plaintiffs in this lawsuit against the government claimed they and their families contracted asbestosis and lung cancer after inhaling the poisonous fireproof insulation while working at asbestos spinning and weaving mills in the Sennan district of southern Osaka Prefecture.
The Osaka District Court on Wednesday ordered the central government to pay to the plaintiffs damages totaling about 435 million yen.
 大阪府南部・泉南地域の石綿紡織工場で働き、石綿肺(じん肺)や肺がんになった元従業員や家族らが国家賠償を求めた訴訟で、大阪地裁は国に約4億3500万円の支払いを命じる判決を出した。

The judicial ruling recognized for the first time the state's responsibility for health problems caused by exposure to asbestos. This latest ruling is expected to influence the outcomes of similar lawsuits pending in Tokyo, Yokohama and Kobe.
 石綿被害をめぐり、国の責任を認めた初の司法判断である。東京、横浜、神戸の各地裁で争われている同種訴訟にも、大きな影響を与えるだろう。

The ruling said the government had acted unlawfully by failing to put in place ordinances that would require ventilators in workplaces that deal with asbestos by 1960, when the original pneumoconiosis law was enacted. Such ordinances were designed to reduce health hazards and prevent health problems from spreading.
 判決は、旧じん肺法が成立した1960年までに、国として排気装置の設置を義務付けるなど、危険性を減らし、被害の拡大を防ぐための省令を制定しなかったことを、違法と認定した。

The ruling also said the government had broken the law by not mandating that such workplaces report asbestos dust density levels and take appropriate action, even after a 1972 revelation that there was a causal link between asbestos and lung cancer and mesothelial tumors.
 72年には肺がん、中皮腫との因果関係について医学的見解が明らかになったのに、粉じん濃度の測定結果の報告や改善措置を義務付けなかったことも違法とした。

"By not using its power [the government] has deviated from its permissible limits and has been grossly irrational, and thus its actions were illegal," the ruling said, harshly criticizing the negligence of the central government.
 「権限の不行使が、許容される限度を逸脱し、著しく合理性を欠き違法」と、判決は国の怠慢を厳しく批判している。

Ignorance wasn't bliss

Since the late Meiji era (1868-1912), the Sennan district has been peppered with asbestos-related factories and mills. These factories were involved in the production of munitions during the years leading up to World War II and underpinned the nation's key industries after the war.
 泉南地域には明治末期から石綿関連の工場が多数集まり、戦前は軍需産業、戦後は国の基幹産業を下支えしてきた。

The workers at most of these workplaces--which were run by small businesses--continuously inhaled asbestos, unaware of the danger, and eventually contracted related illnesses.
零細業者がほとんどで、従業員は危険性の認識もないまま石綿を吸い込み続け、病に侵されていった。

In regard to this, the court said, "The central government also failed to provide people with the appropriate information concerning asbestos and the health risks linked to it."
 その点を判決は、「国民に対する石綿被害や危険性に関する適切な情報提供についても、やはり国は怠ったと言わざるを得ない」と指摘した。

If this information had been made public earlier, fewer people's health would have been adversely affected.
危険情報が早期に伝えられていれば、被害の拡大はもっと抑えられたかもしれない。

As asbestos that has been inhaled can lie dormant for a long time before becoming pathogenic, the causal link between disease and asbestos dust has been traditionally difficult to pin down.
 石綿の吸引から病気発症までは長い潜伏期間があり、粉じんと被害の因果関係はわかりにくい。

Yet international research and medical and epidemiological studies in the Sennan district have uncovered the causal link. The central government should be held seriously responsible for having made light of these findings.
しかし、海外の研究や泉南地域での医学・疫学調査の結果は、因果関係を指摘していた。国がこれらを軽視してきた責任も重大だ。

State's role greater than ever

With regards to nonfeasance on the part of public administrators, there has been a growing trend toward courts ordering the state to pay damages.
In 2004, the Supreme Court ruled against the state, ordering it to pay damages to former coal miners who were suffering from black lung disease in the Chikuho district of Fukuoka Prefecture. The same year, the top court also ordered the central government to pay damages to a group of Minamata mercury poisoning victims then living in the Kansai region.
 行政の不作為をめぐっては、筑豊じん肺訴訟や関西水俣病訴訟の最高裁判決(いずれも2004年)が、国に賠償を命じるなど流れが定着しつつある。

The state's responsibility to protect our health has become greater than ever.
国民の健康、安全を守る行政の責任はますます重くなっている。

Even after the World Health Organization in 1972 issued an alert on the carcinogenicity of asbestos, the nation continued its mass consumption of asbestos to meet the demand brought about because of the country's high economic growth.
 世界保健機関(WHO)が石綿の発がん性を警告した72年以降も、日本では経済成長の波に乗り石綿の大量消費が続いていた。

The widespread use is now coming back to haunt us whenever a building or school built at that time is torn down. We hope the central government will be serious in its efforts to eliminate the damage brought on by asbestos.
 それが今、ビルや学校などの解体現場で問題化しつつある。国は石綿被害の解消に真剣に取り組んでもらいたい。
